NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
\nNUMBER 100-153, GREENBACKVILLE HARBOR<\/p>\n

EFFECTIVE 15 JANUARY 2026<\/p>\n

Pursuant to Title 28.2, Chapter 8, \u00a7\u00a7 28.2-803 through 28.2-808, \u00a7 32.1-20, and \u00a7 2.2-4002, B.16 of the Code of Virginia.<\/p>\n

1. The \u201cNotice and Description of Shellfish Area Condemnation Number 100-153, Greenbackville Harbor,\u201d effective 12 November 2008, is cancelled effective 15 January 2026.<\/p>\n

2. Condemned Shellfish Area Number 100-153, shown as Section A, is hereby established effective 15 January 2026.. It shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled \u201cGreenbackville Harbor, Condemned Shellfish Area Number 100-153, 15 January 2026.\u201d which is part of this notice.<\/p>\n

3. Conditionally Approved Shellfish Area (Closed Status) Number 100-153, shown as Section M1, is hereby established effective 15 January 2026., and shall remain in force until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled \u201cGreenbackville Harbor, Condemned Shellfish Area Number 100-153, 15 January 2026.,\u201d which is a part of this notice.<\/p>\n

4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.<\/p>\n

BOUNDARIES OF CONDEMNED AREA NUMBER 100-153<\/p>\n

A. The condemned area shall include that portion of Greenbackville Harbor located in the Commonwealth of Virginia and lying inland of a line drawn between latitude\/longitude map coordinate (38\u00b000'23.7\",-75\u00b023'23.3\") and map coordinate (38\u00b000'24.1\",-75\u00b023'18.6\").<\/p>\n

M1. The conditionally approved (closed status) area shall include that portion of Chincoteague Bay and Greenbackville Harbor inland of a line drawn between latitude\/longitude map coordinate (38\u00b000'24.3\",-75\u00b023'23.8\") and map coordinate (38\u00b000'25.2\",-75\u00b023'19.5\"); and is shown as part of Section A.<\/p>\n<\/div>\n<\/div><\/div><\/div>
