NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
\nNUMBER 101-020, CHINCOTEAGUE CHANNEL AND VICINITY<\/p>\n

EFFECTIVE 15 AUGUST 2025<\/p>\n

Pursuant to Title 28.2, Chapter 8, \u00a7\u00a7 28.2-803 through 28.2-808, \u00a7 32.1-20, and \u00a7 2.2-4002, B.16 of the Code of Virginia:<\/p>\n

1. The \u201cNotice and Description of Shellfish Area Condemnation Number 101-020, Chincoteague Channel and Vicinity,\u201d effective 29 May 2015, is canceled effective 15 August 2025.<\/p>\n

2. Condemned Shellfish Area Number 101-020, shown as Sections A through G, is established effective 15 August 2025. As to Sections A, B and C, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. As to Sections D through G, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose. The boundaries of these areas are shown on the map titled \u201cChincoteague Channel and Vicinity, Condemned Shellfish Number 101-020, 15 August 2025\u201d which is part of this notice.<\/p>\n

3. Conditionally Approved Shellfish Area (Closed Status) Number 101-020, shown as Section M1, is hereby established effective 15 August 2025. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in \u00a7 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled \u201cChincoteague Channel and Vicinity, Condemned Shellfish Area Number 101-020, 15 August 2025\u201d which is part of this notice.<\/p>\n

4. The Department of Health will receive, consider and respond to petitions by any interested person at any time with respect to reconsideration or revision of this order.<\/p>\n

BOUNDARIES OF CONDEMNED AREA NUMBER 101-020<\/p>\n

A. The condemned area shall include that portion of the Chincoteague Bay inland of a line drawn between latitude \/ longitude map coordinate (37\u00b057'00.5\",-75\u00b021'29.5\"), map coordinate (37\u00b056'36.4\",-75\u00b022'06.8\"), map coordinate (37\u00b056'29.8\",-75\u00b022'05.7\"), and map coordinate (37\u00b056'29.3\",-75\u00b022'04.3\").<\/p>\n

B. The condemned area shall include that portion of Fowling Gut and all of Andrews Landing Gut inland of a line drawn between latitude \/ longitude map coordinate (37\u00b053'58.2\",-75\u00b023'43.4\") and map coordinate (37\u00b053'58.3\",-75\u00b023'41.8\"); as well as inland of a line drawn between map coordinate (37\u00b054'37.6\",-75\u00b023'57.5\") and map coordinate (37\u00b054'37.8\",-75\u00b023'57.3\"); as well as inland of a line drawn between map coordinate (37\u00b054'31.2\",-75\u00b024'05.8\") and map coordinate (37\u00b054'31.0\",-75\u00b024'06.0\"); but excluding the area defined as Section C.<\/p>\n

C. The condemned area shall include that portion of Fowling Gut upstream of a line drawn between latitude \/ longitude map coordinate (37\u00b054'40.1\",-75\u00b023'49.4\") and map coordinate (37\u00b054'39.5\",-75\u00b023'48.4\").<\/p>\n

D. The condemned area shall include that portion of the Chincoteague Channel in the vicinity of the United States Coast Guard station inland of a line drawn between latitude\/longitude map coordinate (37\u00b055'58.6\",-75\u00b022'52.1\"), map coordinate (37\u00b056'00.6\",-75\u00b022'54.6\"), map coordinate (37\u00b055'54.1\",-75\u00b023'04.7\"), and map coordinate (37\u00b055'50.9\",-75\u00b023'01.7\").<\/p>\n

E. The condemned area shall include that portion of the Chincoteague Channel inland of a line drawn between latitude \/ longitude map coordinate (37\u00b056'14.0\",-75\u00b022'24.6\"), map coordinate (37\u00b056'14.4\",-75\u00b022'25.2\"), map coordinate (37\u00b056'08.6\",-75\u00b022'32.4\"), and map coordinate (37\u00b056'08.0\",-75\u00b022'31.6\").<\/p>\n

F. The condemned area shall include that portion of Lewis Creek southwest of a line drawn between latitude \/ longitude map coordinate (37\u00b056'29.8\",-75\u00b022'05.7\") map coordinate (37\u00b056'29.3\",-75\u00b022'04.3\"); as well as northeast of a line drawn between map coordinate (37\u00b056'26.4\",-75\u00b022'09.0\") and map coordinate (37\u00b056'25.4\",-75\u00b022'08.2\").<\/p>\n

G. The condemned area shall include that portion of the Chincoteague Channel, in the vicinity of the road intersection of South Main Street and Bunting Road, inland of a line drawn between latitude \/ longitude map coordinate (37\u00b055'34.1\",-75\u00b023'17.3\"), map coordinate (37\u00b055'34.5\",-75\u00b023'17.8\"), map coordinate (37\u00b055'36.4\",-75\u00b023'15.7\"), and map coordinate (37\u00b055'35.8\",-75\u00b023'14.7\").<\/p>\n

M1. The conditionally approved area (closed status) shall include that portion of the Chincoteague Channel inland of a line drawn between latitude \/ longitude map coordinate (37\u00b056'25.4\",-75\u00b022'08.2\"), map coordinate (37\u00b056'26.4\",-75\u00b022'09.0\"), map coordinate (37\u00b056'28.7\",-75\u00b022'17.0\"), map coordinate (37\u00b056'21.8\",-75\u00b022'28.4\"), map coordinate (37\u00b055'58.1\",-75\u00b023'10.9\"), map coordinate (37\u00b055'38.1\",-75\u00b023'29.4\"), map coordinate (37\u00b055'02.5\",-75\u00b023'41.9\"), map coordinate (37\u00b054'44.5\",-75\u00b024'00.0\"), map coordinate (37\u00b054'23.2\",-75\u00b024'28.1\"), map coordinate (37\u00b054'15.7\",-75\u00b024'34.6\"), and map coordinate (37\u00b054'01.5\",-75\u00b024'26.5\"); but shall exclude the areas described in Sections B through E as well as Section G.<\/p>\n<\/div>\n<\/div><\/div><\/div>
