NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 077-138, HUNTING, BAGWELL AND DEEP CREEKS

Pursuant to Title 28.2, Chapter 8, § 28.2-803 through 28.2-808, § 32.1-20, and § 2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 077-138, Hunting, Bagwell and Deep Creeks,” effective 15 August 2025, is cancelled effective 15 June 2026.
2. Condemned Shellfish Area Number 077-138, shown as Sections A through D, is hereby established, effective 15 June 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Hunting, Bagwell and Deep Creeks, Condemned Shellfish Area Number 077-138, 15 June 2026” which is part of this notice.
3. Conditionally Approved Shellfish Area (Seasonally Closed status) Number 077-138, shown as Section M1, is hereby established effective 15 June 2026, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Hunting, Bagwell and Deep Creeks, Condemned Shellfish Number 077-138, 15 June 2026” which is part of this notice.

A. The condemned area shall include that portion of Bagwell Creek and its tributaries lying upstream of a line drawn between latitude / longitude map coordinate (37°48'13.9",-75°42'01.7") and (37°48'14.7",-75°41'56.2").
B. The condemned area shall include that portion of Hunting Creek and its tributaries lying upstream of a line drawn between latitude / longitude map coordinate (37°47'21.6",-75°42'25.1") and map coordinate (37°47'14.5",-75°42'24.1").
C. The condemned area shall include that portion of the Pocomoke Sound at Webb Island within a 125 meter radius surrounding latitude / longitude map coordinate (37°48'29.5",-75°44'29.8").
D. The condemned area shall include that portion of the Pocomoke Sound at Russell Island within a 125 meter radius surrounding latitude / longitude map coordinate (37°48'08.6",-75°46'07.8").
M1. The conditionally approved (seasonally closed) area shall include that portion of Deep Creek inland of a line drawn between latitude / longitude map coordinate (37°46'08.6",-75°44'59.2"), map coordinate (37°46'07.5",-75°44'55.5"), map coordinate (37°46'02.8",-75°44'58.1"), and map coordinate (37°46'04.2",-75°45'01.6").
