NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 078-086, TANGIER ISLAND

Pursuant to Title 28.2, Chapter 8, §§28.2-803 through 28.2-808, §32.1-20, and §2.2-4002, B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 078-086, Tangier Island,” effective 6 November 2013, is cancelled effective 15 March 2025.
2. Condemned Shellfish Area Number 078-086, shown as Sections A and B, is hereby established effective 15 March 2025. As to Section A, it shall be unlawful for any person, firm, or corporation to take shellfish from this area, for any purpose, except by permit granted by the Marine Resources Commission, as provided in Section 28.2-810 of the Code of Virginia. As to Section B, it shall be unlawful for any person, firm or corporation to take shellfish from this area for any purpose. The boundaries of these areas are shown on the map titled “Tangier Island, Condemned Shellfish Area Number 078-086, 15 March 2025” which is part of this notice.
3. The Conditionally Approved Shellfish Area (closed status) Number 078-086, shown as Section M1, is hereby established effective 15 March 2025. It shall be unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Tangier Island, Condemned Shellfish Area Number 078-086, 15 March 2025” which is part of this notice.

A. The condemned area shall include most of the waters of the Mailboat Harbor, Tangier North Channel and the waters of the Chesapeake Bay surrounding the area defined as Section B. These waters are inland of a line drawn from latitude / longitude map coordinate (37°50'11.6",-75°58'56.8") and map coordinate (37°50'06.5",-75°58'44.5"); as well as inland of a second line drawn from map coordinate (37°49'47.2",-75°58'51.4") and map coordinate (37°49'34.3",-75°59'14.0"), as well as inland of a third line drawn from map coordinate (37°48'58.1",-75°59'28.6") to map coordinate (37°48'54.1",-75°59'35.3"), as well as inland of a fourth line drawn from map coordinate (37°49'07.5",-75°59'56.8"), map coordinate (37°49'07.0",-76°00'50.7"), map coordinate (37°50'00.8",-76°00'51.3"), and map coordinate (37°50'01.3",-75°59'56.8" please replace coordinate); as well as inland of a fifth line drawn from map coordinate and map coordinate ; but excluding the area defined as Section B.
B. The condemned area shall include all of the Chesapeake Bay enclosed by a circle of 200 yards radius around a point defined as latitude/longitude map coordinate (37°49'35.0",-76°00'24.1").
M1. The conditionally approved area (closed status) shall include that portion of Mailboat Harbor and Tangier North Channel lying east of a line drawn from latitude / longitude map coordinate (37°49'57.3",-75°59'55.6") and map coordinate (37°49'55.1",
-75°59'52.9"); as well as west of a line drawn from map coordinate (37°50'02.7",-75°59'04.6") and map coordinate (37°49'34.3",-75°59'14.0"); as well as south of a line drawn from map coordinate (37°50'04.7",-75°59'29.4") and map coordinate (37°50'08.9",-75°59'14.7"); as well as north of a line drawn across West Ridge Creek from map coordinate (37°49'11.1",-75°59'43.3") and map coordinate (37°49'12.0",-75°59'39.6"); and north of a second line drawn across Canton Creek from map coordinate (37°49'01.1",-75°59'28.0") and map coordinate (37°48'58.1",-75°59'28.6"); and is included in the area defined as Section A.
