NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 080-013, ONANCOCK CREEK

1. The “Notice and Description of Shellfish Area Condemnation Number 080-013, Onancock Creek,” effective 17 May 2025, is cancelled effective 15 April 2026.
2. Condemned Shellfish Area Number 080-013, shown as Sections A, B, and C is hereby established effective 15 April 2026. As to Sections A and B, it shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. As to Section C, it shall be unlawful for any person, firm, or corporation to take shellfish from this area for any purpose. The boundaries of these areas are shown on the map titled “Onancock Creek, Condemned Shellfish Area Number 080-013, 15 April 2026” which is part of this notice.
3. Condemned Shellfish Area Number 080-013, shown as Sections C9, C20, C31, and C32, is hereby established effective 15 April 2026. Pursuant to § 28.2-808(3) of the Code of Virginia, such conditional condemnation is predicated upon predictable pollution events arising from excess rainfall. These areas shall be placed in the closed status at 12:01 a.m. the day following a 24-hour rainfall event of greater than a total of 1 inch in Onancock Creek. The source of the data indicating the total 24-hour rainfall will be the National Oceanic and Atmospheric Administration’s Multisensor Precipitation Estimator for latitude / longitude coordinate (37.72015099,-75.78875139 decimal degrees), or (37°43'12.5",-75°47'19.5" degrees, minutes, and seconds). The time interval used to measure the 24-hour rainfall event will be the 24-hour period ending at 8:00 p.m. on the day prior to the effective date of the closed status. The closed status of the conditionally approved area shall remain in effect for 10 calendar days and shall revert to the open status at 12:01 a.m. on the 11th calendar day from the effective date of the closed status. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in Section 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Onancock Creek, Condemned Shellfish Area Number 080-013, 15 April 2026” which is part of this notice.
4. Conditionally Approved Shellfish Area (seasonally closed status) Number 080-013, shown as Sections M1 and M2, is hereby established effective 15 April 2026, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Onancock Creek, Condemned Shellfish Area Number 080-013, 15 April 2026” which is part of this notice.
5. Conditionally Approved Shellfish Area (closed status) Number 080-013, shown as Sections M3 and M4, is hereby established effective 15 April 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Onancock Creek, Condemned Shellfish Area Number 080-013, 15 April 2026” which is part of this notice.

A. The condemned area shall include that portion of Onancock Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°42'43.8",-75°46'23.9") and map coordinate (37°42'52.4",-75°46'20.1"); but excludes the area defined as Section C.
B. The condemned area shall include that portion of Cedar Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°43'16.3",-75°46'37.4") and map coordinate (37°43'13.9",-75°46'33.8").
C. The condemned area shall include all of the North Branch of Onancock Creek upstream of a line drawn between latitude / longitude map coordinate (37°42'45.9",-75°45'22.7") and map coordinate (37°42'44.6",-75°45'21.1").
C9. The conditionally approved area shall include that portion of Onancock Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°42'56.7",-75°46'54.7") and map coordinate (37°42'57.6",-75°46'45.1"); but excludes the areas defined as Sections A and C.
C20. The conditionally approved area shall include that portion of Finneys Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°42'58.2",-75°48'11.6") and map coordinate (37°43'03.3",-75°48'10.0").
C31. The conditionally approved area shall include that portion of Parkers Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°42'55.8",-75°48'40.8") and map coordinate (37°42'54.2",-75°48'33.7").
C32. The conditionally approved area shall include that portion of Cedar Creek and its tributaries upstream of a line drawn between latitude/longitude map coordinate (37°43'08.8",-75°46'47.8") and map coordinate (37°43'08.8",-75°46'44.9"); but excludes the area defined as Section B.
M1. The conditionally approved area (seasonally closed status) shall include that portion of Parker Creek inland of a line drawn between latitude / longitude map coordinate (37°43'12.3",-75°48'41.7"), map coordinate (37°43'06.7",-75°48'38.9"), and map coordinate (37°43'04.8",-75°48'46.1").
M2. The conditionally approved area (seasonally closed status) shall include that portion of Poplar Cove inland and upstream of a line drawn between latitude / longitude map coordinate (37°43'31.8",-75°47'26.9") and map coordinate (37°43'30.0",-75°47'19.5").
M3. The conditionally approved area (seasonally closed status) shall include that portion of the Central Branch of Onancock Creek upstream of a line drawn between latitude / longitude map coordinate (37°42'43.9",-75°45'25.6") and map coordinate (37°42'41.2",-75°45'22.5"), as well as downstream of a second line drawn between map coordinate (37°42'45.9",-75°45'22.7") and map coordinate (37°42'44.6",-75°45'21.1"), and downstream of a third line drawn between map coordinate (37°42'37.6",-75°45'15.3") and map coordinate (37°42'39.1",-75°45'13.1"); and is shown as part of Section A.
M4. The conditionally approved area (seasonally closed status) shall include that portion of the South Branch of Onancock Creek upstream of a line drawn between latitude / longitude map coordinate (37°42'35.2",-75°45'27.8"), map coordinate (37°42'34.5",-75°45'31.0"), and map coordinate (37°42'29.9",-75°45'27.9"); and is shown as part of Section A.
