NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 100-097, SWANS GUT CREEK AND COCKLE POINT

1. The “Notice and Description of Shellfish Area Condemnation Number 100-097, Swans Gut Creek and Cockle Point,” effective 6 December 2018, is cancelled effective 15 January 2026.
2. Condemned Shellfish Area Number 100-097, shown as Sections A through D, is hereby established effective 15 January 2026. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Swans Gut Creek and Cockle Point, Condemned Shellfish Area Number 100-097, 15 January 2026,” which is a part of this notice.
3. Conditionally Approved Shellfish Area (Closed Status) Number 100-097, shown as Section M1, is hereby established effective 15 January 2026, and shall remain in force until rescinded. It shall be unlawful for any person, firm, or corporation to take shellfish from this area during such period for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Swans Gut Creek and Cockle Point, Condemned Shellfish Area Number 100-097, 15 January 2026,” which is a part of this notice.

A. The condemned area shall include that portion of Swans Gut Creek upstream of a line drawn between latitude/longitude map coordinate (37°59'11.5",-75°25'42.8") and map coordinate (37°59'12.4",-75°25'41.2").
B. The condemned area shall include all of westernmost of the unnamed Captains Cove neighborhood canals inland of a line drawn between latitude/longitude map coordinate (37°59'07.2",-75°25'29.0") and map coordinate (37°59'07.7",-75°25'27.9").
C. The condemned area shall include Cockle Point Harbor and that portion of the unnamed Captains Cove neighborhood canal inland of a line drawn between latitude/longitude map coordinate (37°59'12.5",-75°25'05.6") and map coordinate (37°59'12.0",-75°24'59.4").
D. The condemned area shall include all of easternmost of the unnamed Captains Cove neighborhood canals inland of a line drawn between latitude/longitude map coordinate (37°59'13.3",-75°24'33.9") and map coordinate (37°59'13.1",-75°24'31.4").
M1. The conditionally approved area (closed status) shall include Cockle Point Harbor and that portion of the unnamed Captains Cove neighborhood canal upstream and inland of a line drawn between latitude/longitude map coordinate (37°59'12.5",-75°25'05.6") and map coordinate (37°59'12.0",-75°24'59.4"); as well as downstream of a second line drawn between map coordinate (37°59'12.9",-75°24'59.3") and map coordinate (37°59'14.2",-75°24'58.9"); as well as downstream of a third line drawn between map coordinate (37°59'16.4",-75°24'58.5") and map coordinate (37°59'17.7",-75°24'58.3"); as well as downstream of a fourth line drawn between map coordinate (37°59'21.2",-75°24'59.1") and map coordinate (37°59'19.7",-75°24'57.8"); and is shown as part of Section C.
