NOTICE AND DESCRIPTION OF SHELLFISH AREA CONDEMNATION
NUMBER 101-223, ASSATEAGUE CHANNEL

በአርዕስት 28.2 መሠረት፣ ምዕራፍ 8፣ §§ 28.2-803 እስከ 28.2-808፣ § 32.1-20፣ እና § 2.2-4002፣ B.16 of the Code of Virginia:
1. The “Notice and Description of Shellfish Area Condemnation Number 102-223, Assateague Channel,” effective 14 April 2008, is canceled effective 15 August 2025.
2. Condemned Shellfish Area Number 101-223, shown as Sections A and B, is hereby established effective 15 August 2025. It shall be unlawful for any person, firm, or corporation to take shellfish from these areas for any purpose, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Assateague Channel, Condemned Shellfish Number 101-223, 15 August 2025” which is part of this notice.
3. Conditionally Approved (Seasonally Closed Status) Shellfish Area Number 101-223, shown as Sections M1 and M2, is hereby established effective 15 August 2025, and shall remain in force annually thereafter for the period beginning the first day of April through the last day of October until rescinded. It is unlawful for any person, firm or corporation to take shellfish from these areas during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of these areas are shown on the map titled “Assateague Channel, Condemned Shellfish Number 101-223, 15 August 2025” which is part of this notice.
4. Conditionally Approved (Open Status) Shellfish Area Number 101-223, shown as Section M3, is hereby established effective 15 August 2025, and shall remain in force annually thereafter until rescinded. It is unlawful for any person, firm or corporation to take shellfish from this area during such period for any purpose while in the closed status, except by permit granted by the Marine Resources Commission, as provided in § 28.2-810 of the Code of Virginia. The boundaries of this area are shown on the map titled “Assateague Channel, Condemned Shellfish Number 101-223, 15 August 2025” which is part of this notice.

A. The condemned area shall include all of Black Point Drain and its tributaries upstream of a line drawn from latitude / longitude map coordinate (37°54'15.1",-75°23'05.1") to map coordinate (37°54'21.3",-75°23'06.6").
B. The condemned area shall include all of Sheepshead Creek and its tributaries inland and upstream of a line drawn between latitude / longitude map coordinate (37°55'01.0",-75°22'23.1") and map coordinate (37°54'58.6",-75°22'20.2"), as well as inland of a line drawn between map coordinate (37°54'57.7",-75°22'00.8") and map coordinate (37°55'02.6",-75°21'52.3"), and also inland of a line drawn between map coordinate (37°55'07.3",-75°21'16.6") and map coordinate (37°55'07.8" -75°21'14.3").
M1. The conditionally approved area (seasonally closed status) shall include that portion of the Assateague Channel inland of a line drawn between latitude / longitude map coordinate (37°55'00.2",-75°22'35.5"), map coordinate (37°54'58.0",-75°22'35.3"), map coordinate (37°54'58.5",-75°22'20.4"), and map coordinate (37°55'01.2",-75°22'22.9").
M2. The conditionally approved area (seasonally closed status) shall include that portion of the Assateague Channel inland of a line drawn between latitude / longitude map coordinate (37°54'25.8",-75°22'56.0"), map coordinate (37°54'26.7",-75°22'53.9"), map coordinate (37°54'45.7",-75°23'02.7"), and map coordinate (37°54'45.5",-75°23'03.7").
M3. The conditionally approved area (open status) shall include that portion of the Assateague Channel inland of a line drawn between latitude / longitude map coordinate (37°54'52.1",-75°23'02.7"), map coordinate (37°54'51.3",-75°23'01.3"), map coordinate (37°54'55.6",-75°22'56.9"), and map coordinate (37°54'56.4",-75°22'58.1"); but is shown in the report only.
